Venture Lab Company Limited and its affiliated companies (hereinafter referred to as the “Company” or “ThaiGo”) recognize the importance of personal data and the protection of personal data. The Company therefore issues this Privacy Policy (the “Policy”) to explain how we collect, use, disclose, transfer overseas and/or otherwise process your personal data, your rights as a data subject under the Personal Data Protection Act B.E. 2562 (2019) and other applicable laws and regulations (the “Personal Data Protection Laws”), and how to contact us to exercise your rights under the Personal Data Protection Laws.
1. Scope of this Policy
1.1 This Privacy Policy applies to all personal data that the Company collects, uses, discloses and/or transfers overseas through the Company’s channels and services, including but not limited to the website (e.g., www.hellothaigo.com), mobile application (e.g., ThaiGo), social media channels (e.g., LINE OA, Facebook, Instagram, TikTok, X, LinkedIn and YouTube), online communication channels (e.g., email), telephone, facsimile or in-person communications, questionnaires, contact forms, letters, documents, transactions with the Company, or any other channels or locations where your data is collected and under the Company’s control (e.g., events, contests, competitions, press conferences) (collectively, the “Products and/or Services”), regardless of whether you become a customer or a member of the Company’s Products and/or Services (e.g., website or mobile application visitors, event participants organized or conducted by the Company, or persons subscribing to the Company’s newsletter).
1.2 By visiting, registering for membership, or using the Products and/or Services, you are deemed to have accepted this Privacy Policy and consented to the Company’s collection, use, disclosure, overseas transfer and/or other processing of your personal data as set out in this Policy.
1.3 If you do not consent to the Company’s collection, use, disclosure, overseas transfer and/or other processing of your personal data as set out in this Privacy Policy, please stop using or accessing the Company’s Products and/or Services.
1.4 The Company may issue additional specific privacy policies for particular Products and/or Services. Such specific privacy policies will explain the types of personal data that the Company collects, uses, discloses and/or transfers overseas for those particular Products and/or Services. In the event of any inconsistency between the material provisions of a specific privacy policy and this Privacy Policy, the specific privacy policy shall prevail.
1.5 Please note that this Privacy Policy applies only to activities occurring on or in connection with the Company’s Products and/or Services under the Company’s control, and does not apply to your activities on other websites or platforms provided by third-party service providers that you may access via links on the Company’s Products and/or Services. In such case, the Company recommends that you read and understand the privacy policy or personal data protection terms and conditions of such third-party websites.
2. What is Personal Data
2.1 “Personal Data” under this Policy means any information relating to an identified or identifiable natural person, whether directly or indirectly, but excludes data of deceased persons or data that has been anonymized such that an individual can no longer be identified (anonymous data).
2.2 “Sensitive Personal Data” under this Policy means personal data that the law specifically prescribes as data that may affect the data subject, such as racial or ethnic origin, political opinions, religious or philosophical beliefs, sexual behavior, criminal records, health data, disability data, trade union membership, genetic data, biometric data, etc. (hereinafter, unless otherwise specified, “personal data” and “sensitive personal data” shall be collectively referred to as “Personal Data” or “Data”).
3. The Company’s Collection of Personal Data
In general, the Company will collect or may obtain your personal data voluntarily and directly when you:
3.1 Access, register for, or use the Company’s Products and/or Services (e.g., registering as a member of the Products and/or Services, conducting purchase and payment transactions for the Products and/or Services, posting comments, identity verification, or other information you voluntarily provide while using the Company’s Products and/or Services, etc.).
3.2 Submit any forms or documents through the Company’s Products and/or Services, including but not limited to applications, registrations, service requests, forms, questionnaires or other surveys that you complete or show interest in, whether via the website, mobile application, social media, event venues, or any other channels.
3.3 Subscribe to the Company’s newsletter or consent to register and/or participate in marketing events or activities, public relations, promotions, or customer relationship management activities (e.g., lucky draws, contests, competitions, survey activities, or any event/activity organized by the Company, its business partners, or third-party service providers arranged by or under the supervision of the Company, where your data is requested), whether via the website, mobile application, social media, event venues, or any other channels.
3.4 Communicate, contact, provide feedback, submit complaints and/or make other inquiries to the Company through various channels (e.g., website, mobile application, customer services, social media, or other complaint handling units), whether by phone, mail, SMS, email, or any other means.
3.5 Enter into any agreement or contract, or provide any documents or other information to support any transaction or activity with the Company.
3.6 Use the Products and/or Services via the website, whereby the Company may collect your data through cookies or similar technologies.
3.7 Link your Products and/or Services account with your social media account or other online platform accounts by using Single Sign-On (SSO).
3.8 Permit, via your device settings, any data to be disclosed to the Company’s Products and/or Services.
3.9 Conduct any transactions through or on the Company’s Products and/or Services, or with any payment service provider authorized by the Company.
3.10 Enter the Company’s premises or event venues, public relations events, press conferences, or exhibitions organized or conducted by the Company, its business partners, or the Company’s service providers.
3.11 Provide any other personal data to the Company for any reason. You have the right to choose whether to provide your personal data to the Company. However, certain types of personal data may be necessary for you to access content or use features of the Products and/or Services, for identity verification, or to perform obligations under a contract between you and the Company. If you do not consent to the Company’s collection and processing of certain necessary data, the Company may be unable to provide access to content or certain features of the Products and/or Services to you and/or may be unable to process your request or enter into transactions with you.
In the event that you provide the personal data of a third party to the Company, you represent and warrant the accuracy of such data, and that you have informed such data subject and obtained their consent for the Company to collect, use, disclose and/or otherwise process such third-party personal data.
4. Personal Data Collected by the Company
The Company will collect, use, disclose and/or transfer overseas personal data only to the extent necessary and for purposes relating to the Company’s business operations. The Company will collect and process personal data based on your consent or where permitted by law only. The personal data collected will depend on the relationship between you and the Company and the type of Products and/or Services you use, including but not limited to the following:

However, please be aware that opting out or withdrawing consent for the collection, use, disclosure, overseas transfer and/or other processing of your data may affect your use of the Products and/or Services, for example, you may not receive offers, Products and/or Services, or benefits that are specifically tailored to your needs from the Company or its business partners.
5. Sensitive Personal Data
In offering or delivering Products and/or Services to you, the Company may need to collect, use, disclose and/or transfer overseas sensitive personal data, which may include personal data relating to religious beliefs, race/ethnicity, biometric data, disability data, health data, as applicable. The Company will collect, use, disclose and/or transfer overseas sensitive personal data only when the Company has obtained your consent and/or when necessary for compliance with applicable laws.
In the event that you are required to submit a copy of your national identification card or other official documents to the Company for identity verification or transaction purposes, please redact or conceal any sensitive data, such as religion and blood type (if applicable), prior to submitting such documents to the Company.
If you fail to redact or conceal such information, the Company reserves the right to redact or conceal such information on your behalf to protect your personal data. In such cases, it shall be deemed that the Company has not collected, used, or disclosed such sensitive personal data, and the Company has no intention to process your data regarding religion or blood type.
6. Personal Data of Minors, Quasi-Incompetent Persons, and Incompetent Persons
6.1 The Company does not intend to collect and process personal data of persons under 20 years of age without obtaining parental/guardian consent as required by law, and does not intend to collect and process personal data of quasi-incompetent persons and incompetent persons without obtaining consent from their legal guardians/curators as required by law. You represent and warrant that you have the legal right and capacity to use the Company’s Products and/or Services. Access to or use of the Products and/or Services by persons under 20 years of age, quasi-incompetent persons, or incompetent persons shall be deemed that such persons have obtained consent from their parents/guardians/curators, as applicable.
6.2 If the Company becomes aware that it has unintentionally collected and processed personal data of persons under 20 years of age, quasi-incompetent persons, or incompetent persons without the required consent, the Company will immediately delete such personal data and/or will collect and process such data only based on consent or as permitted by law.

In general, the Company will not disclose or transfer your personal data to external persons or entities unless the Company has obtained your consent or is required to do so under applicable laws. However, for business operations and under the purposes set out in this Policy, the Company may need to disclose or share certain personal data, to the extent necessary, with the following third parties (who may be located in Thailand or abroad):

The Company will retain personal data only as long as necessary to perform contractual obligations or to achieve the purposes specified in this Policy, unless the Company is required to retain data for other reasons, such as legal compliance or dispute verification, in which case the Company may retain data longer than stated. When the Company no longer needs or is not legally required to retain your data, the Company will destroy your personal data or anonymize it so that it can no longer identify an individual (anonymous data).
If you request to unsubscribe from receiving news or newsletters, the Company will delete your personal data as requested. However, the Company may retain your contact information (e.g., email) in a “suppression list / do-not-contact list” to ensure that you will not receive newsletters again in the future.
16. Changes to this Privacy Policy
The Company may change this Privacy Policy from time to time as permitted by law, and will notify such changes on the Company’s website. The revised Privacy Policy will take effect on the date the Company publishes it on such website. The Company recommends that you review this Privacy Policy regularly. Your continued use of the Products or Services via the Company’s website after changes are published will be deemed acceptance of the revised Policy.

You have the right to withdraw your consent at any time in accordance with the procedures specified by the Company, unless withdrawal is restricted by nature, law, or contractual terms. Withdrawal of consent will not affect the lawfulness of collection, use, or disclosure based on your prior consent.
17.2 Right to access and obtain a copy
You have the right to access and obtain a copy of your personal data, unless the Company has the right to refuse under law or court order, or where your request may adversely affect the rights and freedoms of others.
17.3 Right to rectification
You have the right to request that the Company correct your personal data to be accurate, up to date, complete, and not misleading.
17.4 Right to erasure/destruction
You have the right to request that the Company delete or destroy your personal data or anonymize it. However, the Company may refuse if it has lawful grounds to retain your data for legal compliance, establishment, compliance, exercise, or defense of legal claims.
17.5 Right to data portability
You have the right to receive or request transfer of your personal data where the Company has made your data in a commonly readable or usable format by automated tools or devices and can transmit or disclose by automated means. You may request the Company to transfer your data to a third party or request to receive your data that the Company has transferred to a third party, unless technically infeasible or where the Company has lawful grounds to refuse (e.g., public interest tasks, legal obligations, or where portability would infringe others’ rights or freedoms).

You have the right to lodge a complaint with the Personal Data Protection Committee, the Office of the Personal Data Protection Committee, or other competent authorities if you believe the Company’s collection, use and/or disclosure violates applicable laws.
