General Terms and Conditions of Use

These terms and conditions (the “Agreement”) constitute a contract between Venture Lab Co., Ltd. and its affiliated companies (collectively, the “Company” or “ThaiGo”), as the provider of the ThaiGo websites and applications, and the users or members of ThaiGo (the “Users”), as service users. Please read this Agreement carefully and in full.

 

This Agreement governs and sets out the rules and guidelines for Users’ use of the Company’s services on the Company’s websites and applications, in accordance with this Agreement, the Company’s related policies, and to the extent permitted by applicable law. 

 

Use of the Company’s websites or applications is conditional upon the User’s acceptance of the terms and conditions of this Agreement without any modification or exception beyond what is stated herein. The User is not permitted (directly or indirectly) to use the Company’s websites or applications unless the User has expressed consent to accept all terms and conditions set out in this Agreement prior to commencing such use. If the User does not accept any of these terms and conditions, please do not access or use the Company’s websites or applications.

 

By accessing, using, or receiving services; downloading the ThaiGo application from any app store; registering an account; clicking any command/menu; or proceeding to the next page on the ThaiGo website or application, the User is deemed to have accepted this Agreement, which shall be equivalent to the User’s electronic signature. This constitutes the User’s expression of intent that the User understands in detail and agrees to comply with all terms and conditions set out herein, as well as the rules and policies of the Company in all respects. Such expression of intent creates a legally binding obligation to the extent permitted by applicable law.

 

All ThaiGo websites and applications, all intellectual property rights relating to the platforms, member accounts, data, content, and services on the ThaiGo websites and applications are the exclusive property of the Company. Users are granted only a limited, non-exclusive, and revocable license. Intellectual property rights relating to any content or data posted by Users belong to the Users or the relevant licensors.

 

The Company may amend or supplement the terms and conditions of this Agreement from time to time at its discretion. The Company will notify or announce such changes through appropriate channels on the website and/or application, and such changes shall take effect from the date of announcement (or such date as the Company may specify). Any such amendment or supplement shall form part of this Agreement and will be published in an appropriate place on the ThaiGo website and/or application. Users are responsible for reviewing any amendments, supplements, updates, and changes to policies, rules, terms, conditions, and restrictions on their own. Continued use of the ThaiGo website and/or application after such changes shall be deemed the User’s full consent to comply with the amended or supplemented terms and conditions.

 

1. Services on the ThaiGo Website and Application

 

The Company provides the following services on the ThaiGo website and application:

 

1.1 Guide Map Function

A travel itinerary recommendation service in map format, which compiles tourist attractions, historical landmarks, restaurants, beverage shops, exhibition venues, as well as interesting activities and experiences, to enable Users to travel according to their own interests and preferences.

 

Such information and itineraries are prepared by the Company’s experience developers and may be created in collaboration with the Company’s partners, agents, or affiliates who have specialized knowledge and expertise in the relevant areas.

 

Users may access such itineraries either free of charge or via paid access to unlock the information. The purchase is a one-time purchase. Users must register for a member account and may access purchased information an unlimited number of times.

 

The Company reserves the right to revise, improve, or change details of locations, itineraries, criteria, procedures, methods, and/or service conditions as it deems appropriate, and will notify Users via the ThaiGo website and/or application or any other channel the Company considers appropriate. Users will always be able to access the latest version of the information.

 

1.2 E-Guide Function

An audio guide service that presents historical stories, background, architecture, the development of locations, and relevant activities or experiences, to help Users understand the context and enhance their travel experience in Thailand.

 

Users may access this service either free of charge or via paid access to unlock the information. The purchase is a one-time purchase. Users must register for a member account and may access purchased services an unlimited number of times.

 

1.3 Safety Hub Function

A service that facilitates contact with relevant organizations or agencies, such as the Tourist Police, police, fire services, public health officials, or any other agencies, to request assistance in emergencies or force majeure events.

 

The Company acts solely as a channel to relay contact from Users to the relevant organizations or agencies. The Company has no duty to verify the accuracy of information provided by Users and does not guarantee any outcome or assistance. Any decision to provide assistance is at the sole discretion of the relevant organization or agency.

 

IMPORTANT DISCLAIMER:

The ThaiGo Application and the Safety Hub function are NOT a substitute for official emergency services or national emergency hotlines (e.g., 191, 1669, or other local emergency numbers). In critical life-threatening situations, risk of bodily harm, or immediate danger, please dial emergency numbers directly.

 

1.4 ThaiGo Boat Services

Boat cruise services, whether scenic cruises along the Chao Phraya River or cruises with dining at Siam Charoen Nakhon Restaurant, operated under a Tourism Business License in the name of Bangkok Smile Tour Co., Ltd.

 

The ThaiGo website and application act only as a channel for publicity and distribution of electronic tickets. Users must present the purchase confirmation email to staff at the service point to receive the service.

 

The Company reserves the right to adjust or cancel service schedules. If the User cannot accept such changes, the Company will refund the full service fee, and the User agrees not to claim any additional damages from the Company.

 

1.5 Daily Virtual Fare Ticket Service (Day Pass)

A daily virtual fare ticket distribution service, where Users can select the number of usage days: 1 day, 2 days, or 3 days. The ThaiGo website and application act only as a channel for publicity and ticket distribution.

 

Users must use the purchase confirmation email issued by the Company to obtain the virtual fare ticket in the TSB Go Plus application, which is the application of the Company’s partner.

 

The validity period of the virtual fare ticket begins from the time the QR Code is first activated and continues consecutively for the number of days selected at purchase. Users may use such ticket to ride buses and electric boats under Thai Smile Bus Co., Ltd., which is a partner of the Company.

 

1.6 Other Services

Any other services the Company may introduce in the future, for which the Company will notify Users of details, terms, and scope from time to time.

 

The Guide Map service or other functions may display information, links, or connections to third-party websites and services (e.g., restaurant websites, hotels, or partner ticketing systems) solely for the User’s convenience. The Company does not represent, endorse, or have any affiliation with such third parties. The User acknowledges and agrees that accessing and using such third-party websites or services is at the User’s sole risk, and the Company shall not be liable for any loss or damage arising from such use.

 

2. Rules of Use and Membership

2.1 “User” means any natural person, juristic person, or business organization, whether registered under the law or not. Each User may register and hold only one (1) ThaiGo member account. The User represents and warrants that they have legal capacity to enter into transactions and have authority to be bound by this Agreement.

 

2.2 Minors (persons under 20 years of age) must obtain consent from their parents or legal guardians before starting to use or registering as a member of the ThaiGo website and/or application, regardless of whether such use is suitable for the minor’s livelihood and status. If the User is a minor, the User represents that they have requested and obtained such consent prior to use. In such case, as between the Company and the minor or the minor’s parents/legal guardians, the minor shall be solely responsible. The Company shall not be liable for any rights, liabilities, or claims arising from the minor’s use or actions on the ThaiGo website and/or application, or arising from any dispute regarding the minor’s maturity in relation to any legal act in which the minor is involved.

 

2.3 The ThaiGo website and application, in whole or in part, may be used both within and outside Thailand. Users must comply with the laws of Thailand. Users are responsible for providing hardware (computers, mobile devices, communication devices) and software (operating systems) compatible with and able to access the ThaiGo website and application, as well as internet connectivity. Users shall bear any related costs (if any) personally.

 

2.4 “ThaiGo” is a trade name and/or mark that the Company is legally entitled to use and is exclusively protected by law as the right of Venture Lab Co., Ltd. Users must not use or include “ThaiGo” in their username or alias in a manner that may mislead others into believing that the Company is involved, directly or indirectly.

 

2.5 When registering or using the ThaiGo website and/or application, Users must provide accurate, complete, truthful, and up-to-date information, including contact information, in the areas provided by the Company, and only for themselves. Users must update any changed information in their member account or otherwise to ensure it remains accurate, complete, truthful, and current at all times. Any liability or damages (if any) relating to this shall be solely the User’s responsibility. The ThaiGo registration process may use third-party verification technology, including information provided by third-party social media websites, to attempt to verify Users’ qualifications.

 

2.6 Throughout the period of membership or use of the ThaiGo website and/or application, Users agree not to perform any act that violates laws, morals, or the Company’s policies, and not to perform any act that infringes the rights of the Company or others, or that may cause damage to the Company or others.

 

2.7 Member accounts under this Agreement are the sole property of the Company. Users are granted only a limited authorization to hold an account in their own name. Member accounts may not be jointly held, transferred, exchanged, or altered to another person. Users are prohibited from selling, renting, lending, permitting use of, or granting any rights to their ThaiGo member account to any other person for any reason.

 

2.8 Users are responsible for protecting the privacy/confidentiality of their username and password. If Users know or suspect that another person has accessed their member account or learned their username or password without authorization, Users must promptly notify the Company via: [email protected].

 

2.9 Between the Company and Users or third parties, the Company shall have no legal or contractual liability to Users or third parties for any damages, infringements, or losses of any kind arising from or relating to any use of services, any changes or modifications, or any transmission/receipt of information, or any legal acts or transactions occurring between Users themselves or with third parties on the ThaiGo website and/or application.

 

2.10 The Company reserves the right to request additional documents from members and/or require members to verify their identity to ensure that any use on the ThaiGo website and/or application complies with the Company’s policies.

 

2.11 The Company reserves the right, at its sole discretion, to block access to the system or delete a User’s member account at any time for system security, legal compliance, or where the Company believes the User may have violated this Agreement, without prior notice, and such right shall be absolute. Users agree not to claim any damages from the Company.

 

2.12 The Company reserves the right to transfer the ThaiGo website, ThaiGo application, or any ThaiGo services, including ThaiGo rights and obligations, and Users’ accounts and data, in whole or in part, to an affiliate or third party without prior notice or obtaining the User’s consent.

 

3. System and Computer Data Reservations

3.1 The ThaiGo website and application, including the Company’s computer databases and related computer systems, are protected systems with specific access control measures intended for the security and safety of such systems, and are protected under the laws governing computer-related offenses.

 

3.2 No person may unlawfully access the ThaiGo website and application or the Company’s databases/systems; suspend/delay/obstruct system operations; intercept/damage/destroy/alter/modify/add computer data; transmit computer data while concealing or forging its source; input false/untrue/illegal/obscene data into the Company’s databases/systems; or disclose the Company’s system protection measures.

 

3.3 No person may perform any act to connect to, interact with, operate with, or extract data from the Company’s databases/systems (directly or indirectly) with the Company’s databases/systems, such as downloading, uploading, posting, flagging, emailing, or searching by means not provided by the Company or without the Company’s authorization.

 

3.4 No person may use methods such as robots, phishing, spiders, scripts, scrapers, crawlers, spamming, or other similar automated methods, by any means, which are unlawful or undesirable against the Company’s databases and systems.

 

3.5 Without the Company’s written authorization, no person may collect, record, compile, reproduce, modify, transmit, use, or possess for any purpose any content, location data, product and service data, user data, or user contact information, in whole or in part, as displayed on the ThaiGo website and application, including the Company’s databases and other related computer systems.

 

3.6 The Company reserves the right to retain computer traffic data for no less than ninety (90) days from the date such data enters the computer system, in accordance with the Computer Crime Act (No. 2) B.E. 2560 (2017).

 

4. Intellectual Property Reservations

4.1 ThaiGo, by Venture Lab Co., Ltd. and its affiliated companies, is the sole owner of the following:

 

All text, images, animations, audio, data content, and any elements appearing on the ThaiGo website and application, including software and computer programs within the ThaiGo system, are copyrighted works of the Company.

 

Trademarks, service marks, names, trade names, patents, know-how, domain names, or other similar rights protected under intellectual property laws and other applicable laws are the Company’s lawful intellectual property exclusively.

 

4.2 No person may reproduce, copy, imitate, modify, counterfeit, publish, distribute, rent, possess, extract, record, transmit, or otherwise deal with the Company’s intellectual property unlawfully, without the Company’s official authorization, or in a manner that causes damage to the Company. Such acts constitute criminal offenses punishable under intellectual property laws and other applicable laws and also constitute civil infringement against the Company. The Company reserves the right to immediately stop such acts and to take legal action against infringers without exception.

 

4.3 The Company owns copies of the application and all content even after installation of the application and content on mobile devices or similar devices. Users are granted only a license to use the ThaiGo application services.

 

4.4 Subject to this Agreement, the Company grants Users a temporary, non-exclusive, non-transferable, and revocable license to use the ThaiGo website and/or application solely for the purposes of use under this Agreement. Users have no right to reproduce, modify, publish, distribute, rent, sublicense, or otherwise commercially exploit the platform and/or the Company’s content unless the Company has provided prior written consent.

 

4.5 License Granted to the Company for User Content (if any) If Users submit, upload, publish, or otherwise make available any data, content, text, images, audio, video, opinions, or other information through the platform (collectively, “User Content”), Users grant the Company a non-exclusive, royalty-free, worldwide license for the duration necessary for the purposes of providing services, operating, maintaining, improving, developing, troubleshooting, fraud prevention, security monitoring, and promoting ThaiGo services, only to the extent necessary for such purposes.

 

Users represent and warrant that they own the rights or have lawful authorization to grant such license, and that User Content will not infringe third-party rights or violate laws. If any claim or dispute arises regarding User Content, Users agree to be responsible for and indemnify the Company for actual damages incurred (if any) resulting from breach of this representation.

 

4.6 Infringers shall be liable to compensate the Company for damages at a reasonable pre-estimated daily rate, not less than: ten (10) times the selling price per item; or THB 500 per user account; or THB 50 per server data request; or THB 500,000 per day, whichever is higher. Such amount is a reasonable pre-estimation and shall not be deemed punitive damages, and shall not prejudice any other claims the Company may have, including claims for additional losses, damages, or expenses.

 

4.7 Intellectual Property Infringement Notice If you are the owner of intellectual property rights in any product or service posted on the ThaiGo website and application, or are an authorized representative of such owner, and you believe your intellectual property rights have been infringed, you may submit a written notice specifying the relevant listings and providing supporting evidence to: [email protected] for the Company’s review. The Company may cooperate by removing the relevant listings from the system preliminarily in good faith to protect stakeholders’ rights. However, the Company does not guarantee any outcome and bears no liability or obligation for such action. Any dispute and liability shall be solely between the rights claimant and the relevant User.

 

5. Reservations Regarding Use of Products and Services

5.1 The Company continuously develops and provides services. Services may change from time to time, which may require the Company to remove, reject, or limit services without prior notice. In some cases, the Company may collect Users’ feedback or suggestions as it deems appropriate.

 

5.2 Users are not entitled to any refund of fees already paid, whether in part or in whole, whether for one-time services or packages, in any case, except where this Agreement specifically provides for a refund.

 

5.3 Users may not transfer purchased services to another member account. The Company will treat the transaction as belonging to the specified member account. If a User wishes to use services under another member account, the User must pay again.

 

5.4 If Users fail to comply with laws or any terms and conditions in this Agreement, Users agree that the Company has the right, at its sole discretion, to revoke and/or close the member account. Users agree not to claim any damages from the Company and not to request any refund for the value of paid products and services.

 

5.5 User Cancellation and Refund Policy

Unless otherwise specified in the specific terms and conditions of each product or service (e.g., special ticket conditions), all payments for products and services on the ThaiGo website and application (including but not limited to Boat Tickets, Day Passes, and E-Guide content) are final and non-refundable. If a User wishes to cancel, change, or fails to use the service on the scheduled date and time for any reason, the User agrees to accept such risk and waives the right to claim a refund, except in cases where the service is cancelled by the Company itself as specified in Clause 1.4.

 

6. Limitation of Liability

6.1 General Limitations

In addition to any service-specific limitations, the Company limits its liability for providing the ThaiGo website and application as follows:

 

(i) Content, Product Information, and/or Services on the Website and Application

Information displayed on the ThaiGo website and application is prepared based on information received from partner merchants, relevant agencies, and/or third-party service providers, who are responsible for the accuracy of such information.

 

The Company will use reasonable efforts to improve and update information to provide appropriate services to Users. However, such information may be inaccurate, incomplete, outdated, or inconsistent with actual facts. Users should not make decisions based solely on information displayed on the website and application and should verify additional information before proceeding.

 

(ii) Security of Use

Use of the ThaiGo website and application occurs via computer systems and electronic networks. The Company cannot guarantee that the system will be free from viruses, computer worms, Trojan horses, spyware, malware, or other abnormalities that may cause delays, disruptions, or incomplete functionality.

 

Users agree to bear the risks that may affect their computer systems, communication devices, data, or any tools used to access the services, including data loss and/or any direct or indirect damages arising from use of the ThaiGo website and application.

 

6.2 Maximum Liability

To the fullest extent permitted by law, and without prejudice to any other limitations herein, the Company shall not be liable for any damages arising from use of the services for any reason, except for direct damages caused by the Company’s intent or gross negligence.

 

Where the Company is required to be liable to the User, the Company’s liability shall be limited to actual damages and shall not exceed the amount of fees paid by the User to the Company prior to the event giving rise to such damages.

 

6.3 Force Majeure

The Company shall not be liable for any delay, failure to perform services, or any damages caused by events beyond the Company’s reasonable control (“Force Majeure”). Such events include, but are not limited to, acts of God (e.g., storms, floods, earthquakes), pandemics, war, terrorism, riots, strikes, labor disputes, shortages of energy or utilities, technical failures of the internet or telecommunications networks, or changes in laws, orders, or regulations of the government. In such events, the Company reserves the right to cancel or reschedule services without obligation to compensate for any damages, other than considering a refund of service fees at the Company’s sole discretion.

 

7. Security Measures

The Company implements appropriate security measures for the protection of personal data to prevent loss, unauthorized access, use, alteration, amendment, or disclosure of personal data without authority or contrary to law, in accordance with the Company’s information security policies and its Privacy Policy.

9. Amendments

The Company reserves the right to amend, review, and update these terms and conditions from time to time and will notify or announce via appropriate channels on the ThaiGo website and/or application. Users should review the latest terms and conditions before using the services each time.

 

Note: These Terms and Conditions are prepared in both Thai and English. In the event of any conflict, discrepancy, or difference in interpretation between the Thai and English versions, the Thai version shall prevail for the purposes of enforcement and interpretation
